All customers must agree to the terms and conditions of service before commencion of service and by purchasing services from Flying Moth Ltd customers are automatically deemed to have agreed to the terms and conditions of service which may apply.

General Terms Of Service
If it should apply any customers wishing to receive service/s from Flying Moth Ltd. will be required to sign a customer service agreement. This is a legally binding document and is a signed agreement between both Flying Moth Ltd and the customer containing details of the service/s to be provided to the customer by Flying Moth Ltd.
Customers using our services understand and agree that Flying Moth Ltd will not be liable under any circumstances to be held accountable in any sense for any loss of earnings, distress or other situation that may occur from using our services.
By becoming a Customer, Customers agree that by purchasing and recieving Flying Moth Ltd services they do so purely at their own risk and will not hold Flying Moth Ltd or any of its members liable for any form of action against it by doing so.
Flying Moth Ltd including its staff and members accept no kind of responsibility for anything or any situation that may occur resulting from business, contact or exposure to Flying Moth Ltd.
Terms Of Purchase
If it should apply any customers wishing to purchase any consumerble item from Flying Moth Ltd. may be required to sign a purchase agreement for any item/s in question.
Terms Of Payment
On completion of service arranged or unless otherwise agreed between both Flying Moth Ltd. and any other parties concerned an invoice dated post completion of such work will be issued.
Customers must pay any outstanding invoice amount in person or via a third party at our registered office or by sending payment via the postal services such as Royal Mail or a third party to our registered office address. We do not collect payment from customers by either visiting their premises or person unless arranged otherwise.
Payment for an invoice issued must be received by us within 14 days of the date shown on the aforementioned paper - unless otherwise arranged with Flying Moth Ltd. - this means the bill is due as soon as you get it - you have upto 14 days to pay before we take legal action against a non payer - this does not mean you must pay in 14 days time. We expect all customers to pay straight away once an invoice has been issued. This is not a credit account. If customers continually take a long time to pay we will demand payment either on the day of completion of service or we will ban the partie from trading with Flying Moth Ltd.
Should payment not be recieved for any outstanding invoice amount within the time period set then a late payment fee of not more than 30% of the invoice total would apply.
Failure to pay an invoice for services will result in the monetry amount outstanding being retrieved via employment of our legal department and collection agency.
We will contact any Customer at any point before payment is likely to be late - to remind payment is due.
Any items purchased from Flying Moth Ltd remain the property of Flying Moth Ltd. until payment is received in full. We reserve the rite to cancel any unpaid order at any time.
Should payment for any items not be received within the alloted timespan we will be legally entitled to seize and regain, until payment is made, control of our property which has has not been paid for.
If an order is subject to cancellation resulting in items which remain property of Flying Moth Ltd. being located on ground other than that which is our own we will be legally entitled to seize and regain control of our property.
Computer Repair Terms Of Service
Computer repair or 'walk-in' customers must pay upon collection of their property as in any other shop or business unless they already hold an account with Flying Moth Ltd.
WISP Broadband Terms Of Service
1) Customer agrees Flying Moth Ltd cannot be held accountable and will accept no responsibilty for any situation that may occur from the customers use of :
a) The Internet and any parts of it.
b) The Flying Moth Ltd Network
c) Any network directly attached to the Flying Moth Ltd network
2) Using the service (transmitting or downloading) for the following activites is prohibited:
a) Illegal file sharing.
b) downloading/sharing copyrighted works in an illegal manner.
c) downloading/sharing illegal music.
d) downloading/sharing pirate software.
e) downloading/sharing pirate films in any format/media type including dvd and blu-ray.
f) Racist, Indecent or illegal activities.
g) Scam activities.
h) Hacking.
i) Phising.
j) Any form of Electronic Computer Attack including DOS, DDOS.
k) Spam/unsolicted bulk email.
l) Sending threatening, racist or abusive email
m) Sending indecent or illegal content email is prohibited.
n) Sending chain letters or pyramid schemes is prohibited.
Anything else not mentioned which is illegal under the laws of the UK and also any country to which a customer may connect to a service or machine is prohibited.
3) The Services provided by Flying Moth Ltd to the Customer is for a minimum Contracted Period of twelve months and is then subject to one month's notice in writing of termination. Termination notices should be posted to Flying Moth Ltd, , Alexander House, Mindenhall Court, 17a High St, Stevenage, Hertfordshire, SG13UN and the applicable date of notice shall be the date the notice is received by Flying Moth Ltd.
4) a. Flying Moth Ltd will provide the Services to the Customer in accordance with the conditions of this agreement and with reasonable skill and care. Where it is technically impracticable to provide the Services free of faults (such as where it is impossible to achieve sufficient signal quality) Flying Moth Ltd will not undertake to do so.
b. The Customer acknowledges that the Services will depend on the characteristics of the wireless signal quality and that it may not be possible to supply the service at the outset or at some point in the future. In this event Flying Moth Ltd will have the right to terminate this agreement without liability to the Customer.
c. From time to time certain nodes, servers, or the whole or part of the Network may need to be closed down for upgrade, routine repair or maintenance work. Flying Moth Ltd shall give as much notice as in the circumstances is reasonable and shall endeavour to carry out such works during scheduled maintenance periods outside of standard working hours. This work will not affect any SLA that is in place between flying Moth Ltd and the Customer.
d. Equipment provided by Flying Moth Ltd remains the property of Flying Moth Ltd and possession must be surrendered on termination of this agreement.
5) Flying Moth Ltd reserves the right to suspend a Customer's Services if the Customer breaches either our terms and conditions or our acceptable use policy. In such instances, Flying Moth Ltd will provide the Customer with formal notice that the account has been suspended. The Customer remains liable for the monthly fee during such suspension, and service will only be resumed once the breaches have been resolved and/or any overdue amounts (including accrued fines) paid to Flying Moth Ltd.
Web Hosting Terms Of Service
It is the customers respsonsibilty to ensure in case of disaster, that all of their files and materials are backed up by themselves. We do often back up files but do not guarantee that this will happen. Should reinstallation of hosting servers be required through failure or damage we may require customers to resubmit to us their project files as if it was a new account set-up. It is a common sense procedure employed by individuals concerned that they back up their data to more than one location in case of need for recovery.
Racist, Illegal, Indecent, Scam, Hacking, Phishing, Botnet, any form of Electronic Computer Attack including DOS - DDOS, Adult content and anything else not mentioned which is illegal is prohibited.
Email Hosting Terms Of Service
It is the customers duty to make sure their DNS Hosts settings are correct.
It is the customers duty to understand that DNS settings can cause disruption to service and the implications of changing DNS settings.
Customers are billed at the beginning of each month.
Customers failing to make payment within the alotted timespan will have their service turned off - unless payment arrangements are made with Flying Moth Ltd. - you will always be contacted if you run the risk of late payment
It is the customers duty to make sure they have their own back up of their email messages in case of disaster.
It is the customers duty if they require that in case of disaster they have alternative email services available for the time needed. It is a well know practice to never put all your eggs in one basket. Doing this eleviates any risk.
Customers agree that they will not hold Flying Moth Ltd. or any of its members liable for any form of action against it through use of our email service.
Customers agree that they will not hold Flying Moth Ltd. or any of its members liable for any form of action against it relating to lack of service, loss of earnings, loss of data, loss of image, loss of business or any other form of event that may occur from use of our email service.
It is the customers respsonsibilty to obey the law of the land with regards to lawfull use of our email services.
Use of our email services for unsolicited bulk email is prohibited.
Use of our email services for spamming or sending spam email is prohibited.
Use of our email services for sending threatening, racist or abusive email is prohibited.
Use of our email services for sending indecent or illegal content email is prohibited.
Use of our email services for sending chain letters or pyramid schemes is prohibited.
Use of our email services for hacking and electronic computer attacks of any kind is prohibited.
